Attorney General explains reason for not investigating Burlington Telecom

CONTACT: William H. Sorrell, Attorney General, (802) 828-3173

August 12, 2011

“Due to misperceptions arising from a news account of his decision not to investigate alleged criminal conduct by those involved in the City of Burlington’s prohibited use of $17M of taxpayer funds in support of Burlington Telecom, Attorney General Sorrell today released his response to City Councilor Paul Decelles’ request that the Attorney General’s Office revisit the decision of Chittenden County State’s Attorney TJ Donovan’s to file no criminal charges in the BT matter. The Attorney General’s letter makes clear that due to the fact that he was a partner for nearly twelve years in the Burlington law firm that did BT’s legal work and that his Deputy AG was also a member of that firm before assuming her current position, The Attorney General’s Office could not ethically be involved in an investigation and/or prosecution of those responsible for the prohibited use of the taxpayers’ funds. Consequently, he deferred to the investigations and decisions of State’s Attorney Donovan and US Attorney Coffin.
