Attorney General Sues Home Contractor For Consumer Fraud

CONTACT: Jennifer A. Giaimo, Assistant Attorney General, (802) 828-5621

August 6, 2009 - Attorney General William H. Sorrell has filed a consumer fraud lawsuit in Washington County Superior Court against Twin City Roofing, a father-son home improvement business located in Chittenden County. The business, operated by Donald Bevins and his son Daniel Bevins, both of Chittenden County, goes by the names of Twin City Roofing and City Wide Roofing.

The lawsuit stems from numerous consumer complaints against the Bevinses in connection with contracts to install new roofs or repair existing roofs on residences throughout Chittenden County. According to the Complaint, the Bevinses repeatedly gave consumers low price quotes and then refused to continue or complete their work unless the consumer paid sometimes up to double the original price quote. The Complaint also alleges that the Bevinses substituted cheaper material for material that consumers expected and paid for, misrepresented the nature and extent of work they would perform, and refused to honor warranties they had expressly given on their work and materials. Consumers were often left with leaking and defective roofs which the Bevinses refused to fix and for which they refused to provide refunds.

The lawsuit seeks restitution for all consumers who have been defrauded by the Bevinses, civil penalties, an injunction preventing further consumer fraud violations, and costs. Any consumer harmed by the action or inaction of Twin City Roofing, City Wide Roofing, or Donald or Daniel Bevins is encouraged to file a complaint with the Attorney General's Consumer Assistance Program at www.atg.state.vt.us or Consumer Assistance Program, 206 Morrill Hall-UVM, Burlington, VT 05405 as soon as possible. Consumers who have been harmed by other home improvement contractors are also encouraged to file a complaint at the address above.

The Consumer Assistance Program can provide consumers with information on complaints that have been filed against home improvement and other businesses. For information on complaints against a business, call (800) 649-2424 (toll-free in Vermont only) or (802) 656-3183 (Chittenden County).
