Licensed Practical Nurse Charged With Diverting Narcotics And Falsifying Records

September 26, 2007 - Attorney General William H. Sorrell announced today that Danielle Martel, age 19, of Williston, Vermont, was arraigned on September 25, 2007, in Vermont District Court for Chittenden County on one count of Obtaining a Regulated Drug by Deceit and one count of Making a False Statement in Records, both felonies. Ms. Martel was released on standard conditions plus the conditions that she must not buy, have, or use regulated drugs without a prescription and must not administer any direct patient care or work in any setting where she would have direct access to narcotics.

The charges stem from Ms. Martel’s employment as a Licensed Practical Nurse at the Birchwood Terrace Nursing Home in Burlington, Vermont. According to papers filed in Court, Ms. Martel admitted that she removed narcotics for patients with doctors’ orders to dispense the medications as needed, then falsely recorded that she had administered the drugs to patients, when she had actually kept them for her own use.

Ms. Martel pleaded innocent to the charges. If convicted of both charges, she faces potential penalties totaling four years and two days imprisonment and $10,000.00 in fines. The Vermont Office of Professional Regulation has summarily suspended her nursing license and her employment has been terminated.
