Mental Health

The Department of Health's Division of Mental Health is represented by a team of five lawyers, two paralegals, and an administrative secretary. This legal team provides general counsel services and represents the Division in administrative and judicial matters in state and federal courts relating to mental health issues. The lawyers offer advice relating to regulatory and statutory compliance by the Vermont State Hospital, policy development, the implementation of a statewide system of mental health care, and the use of involuntary psychiatric hospitalization and treatment in designated hospitals and mental health centers. The team is also involved in the forensic evaluation process regarding the sanity and competency of defendants and also appears at hearings primarily in the areas of civil commitment, guardianship, administrative grievances and involuntary medication. In addition, the attorneys provide counsel relative to contracting and legislative and rulemaking activities.
